Welcome to the Spring Garden Villas Homeowner's Association website!
Our goal is to be able to provide a forum for new and current residents to download information and contact us about questions and concerns.  Please browse through our pages to view past and present newsletters and minutes and stay up to date on all that is happening in our community.  If you cannot find what you are looking for, please contact either the Board of Directors or our Management Company.  The monthly Association meetings are held the 3rd Wednesday of the month at 7pm.  Please join us!

Announcements...

~We have pictures available on the What's New page of the allowed changes/modifications you can make to your condo with approval.  Be sure and a take a look.

~There has been a dues increase as of June 1, 2008.  If everyone was paying their HOA's each month, which some are not, we might not have this problem!

~There is a camera security system in the complex.  It is for everyone's protection, will help us positively identify those breaking the rules, and capture images of those who should not be in the complex.  Everyone should now have a greater sense of security!

~The Rules and Regulations have been updated, please take a moment to review the changes.

~Homeowner's insurance policies are mandatory.  We are requesting a copy of your policy for our records.

~We submit all overdue accounts to an attorney for collection.  You will be paying late fees, interest, and attorney fees.  It is in everyone's best interest to pay their monthly dues on time and to clear up any fines that are outstanding.

RULES AND REGULATIONS

Parking and Garage:

 

All homeowners must park their cars in their garages. This is not a request.  If you are an owner and your vehicle does not fit into your garage you are eligible to apply for a reserved parking space. Reserved spaces are assigned in the order they are requested. The number is limited and spaces are reassigned after they are released either by the owner moving, renting out their unit or having their parking privilege revoked by the Board. If you have more than two cars please let the board know as soon as possible – you may or may not be able to get a reserved spot. Parking of boats, RVs or trailers is prohibited. No parking is permitted in front of garage doors, roadways or in designated fire lanes. Towing will occur without warning. Please note: The speed limit is 5mph. There is an immediate $150.00 fine for parking behind garage doors, in reserved spots or guest parking. There will also be no double parking in the front lot – failure to comply can result in immediate towing and/or a fine.

 

It is against state, county and local housing laws and is in violation of the CC&Rs to have anyone living in a garage. Code Enforcement will be notified.

 For those of you who are operating a business out of your garage please follow the rules listed in the CC&Rs.

For those of you who have installed a gym in your garage or are using your garage for any other purpose that prevents you from using your garage to park your cars, note that you must make other arrangements so that your cars get parked in your garage and not in guest parking. 

Cars found in violation will be towed.

 

Guest Parking:

If an owner requires more than one day in guest parking please notify the board in advance for approval. Residents are not permitted to use guest parking unless approved by the Board. All owners violating guest parking rules will be towed and you will be fined $150.00 by the Association. All guests must have a guest parking sticker prominently displayed.

 

Common Areas:


Common areas are defined as those areas outside of your unit. This includes driveways, parking spaces, sidewalks, utility closets, landscaping, dumpsters, pool and jacuzzi. Do not place any items or plants in the common area as they will be removed. Do not block stairways. This blocks emergency personnel access to units. Any item found blocking a stairway will be removed. Toys, bikes, skateboards, cleaning supplies, etc. are not to be left unattended, locked or chained in the common areas.


If any damage is done to the common area, such as breaking the front gate, landscaping destruction or buildings, a fine of $100.00 will be assessed plus the homeowners will be required to replace or repair at their cost. You are responsible for your children, tenants and guests while they are in the complex.


Electrical Boxes:


Do not ever cut the locks off the boxes
. If you are experiencing difficulties please contact Edison. They have keys to the locks. If you cut the locks off you will be subject to a $250.00 fine.

 

Pool:


The pool is a major liability issue. THERE IS NO LIFEGUARD ON DUTY AT ANY TIME. There is a sign stating the pool hours which will be
6:00am to 10:00pm Sunday - Thursday and 6:00am to 11:00pm Friday and Saturday. The pool will not be heated during the winter months because of the expense and lack of use. The jacuzzi will always be heated and available. All homeowners will have one key to the pool gate. They cannot be duplicated. The pool and jacuzzi can also not be used by anyone under the age of 18 unless they are accompanied by an adult. There will be no boisterous, rough play, diving or jumping or other unsafe conduct allowed. Drinks can only be served in non-glass containers. Owners/residents must accompany guests when using pool facilities and no more than four guests per owner/resident is allowed without permission from the Board. These rules will be enforced and homeowners will be fined if these rules are broken. Lost keys will result in a $150.00 replacement charge. Unsupervised children will result in an immediate $150.00 fine. Please note that children in diapers must wear waterproof diapers only and anyone using the pool must wear appropriate swim attire. Repeated offenses will result in loss of pool privileges. Do not ever make any changes to the pool equipment! This is absolutely forbidden.


If you wish to use the pool for a party please let the Board know in advance to get permission and please leave the area clean and free of debris of any kind when you are finished.

 

Trash:

 

Trash may not sit outside any door for any length of time. This is plain common courtesy to the other owners and will prevent rodent or bug infestations. Trash outside individual units is not acceptable. If you smoke, please do not throw your butts on the ground. Violators will be fined. Trash must always be bagged before it is thrown in the dumpster. If the dumpster is full please find another one – do not overfill the dumpster! And make sure your trash does not fall to the ground but lands where it should – this means you must open the door to ascertain where the dumpster is located.

 

Bulky refuse, including mattresses, furniture, construction materials, tires, etc. may not be placed in the bins. Any expense incurred to remove such material will be billed to the resident, in addition to a fine. All owners must remove hazardous substances such as paint, batteries, etc. from the premises.

 

Mail:


Be courteous and do not throw or set mail on top of the postbox. Violators will be fined.

 

Outside Recreation:

Unfortunately, this complex is not designed for recreational use except for the pool and jacuzzi. Children and/or adults are absolutely forbidden from playing, riding or skateboarding in the areas behind the garages. We would advise anyone that is not in a vehicle to refrain from using this area to exercise or any other non-vehicle purpose. Do not allow your children to bounce any type of ball or toy off of a garage door or a common area fence. No ball playing such as soccer, football or baseball is allowed in the complex. There are also no bicycles, skateboards, roller skates or scooters allowed in the common area.

 

Keys and Garage Openers:


It is the responsibility of the new owners to pass their keys and garage door openers to their new buyers or tenants.

 

Structural Changes:

Anything that affects the outside of your unit must be cleared by the Board and submitted to the architectural board for review as covered in the CC&Rs. The current Board has decided by a unanimous vote to allow several changes and modifications to the units. Please refer to the web site for all permitted changes or contact the management company.

Please, remember to get Board permission before you change anything. There will be a form attached to the Rules and Regulations packet that you may use to request Board approval for changes you wish to make – you must submit this form even for changes the Board has already approved. Make copies of this form or you can always obtain a form from the Board or management company or from the web site. This is very important – you do not want to make a change that you will be forced to remove at a later date. It is advisable to wait for the packet to be in your possession showing the examples of acceptable changes for doors, windows, spigot installations, and gates before you make any changes.

 

Patio Areas:

In order to maintain the look of the complex we ask all owners to be mindful of what they leave outside their front door. Only outside furniture is to be placed outside. Please refer to your copy of the CC&Rs for further clarification. You will be given only one opportunity to fix the problem or a fine will be assessed and the offending furniture or other items removed. 

 

Decks, Balconies, Plants and Umbrellas:

Plants and umbrellas are appropriate, but not on the railings. Beige, market style, umbrellas can be used on the decks and patios and are the only fixtures allowed. Also, there is no hanging of clothes or other articles over balcony railings. If you have a bulky item that must hang dry, please use your garage or if it must be left outside, it may not remain overnight. This option is only available on a very limited basis.

 

Animals:

 

If you have pets, please be considerate. Do not allow them to annoy or engage in obnoxious behavior. They must also be leashed if they are in the common area – no exceptions. Always clean up after your pets! It is a $25.00 fine for each offense.

 

Seasonal Decorations:


Do not put up Christmas lights until the day after Thanksgiving and remove them by January 6th. If you decorate for other holidays please install and remove, in a timely manner (nothing longer than 2 weeks), anything you put up. Remember; install nothing in the common areas without permission – this includes outside your unit. The only exception is the American flag which is not subject to Association rules and is a federally protected right.


Rentals:


Any owner leasing/renting a unit must provide the Board of Directors and management company with the following information in writing before a new tenant moves in:

·          Name of tenant(s) residing in unit – number of children and ages

·          Tenant’s home and emergency work numbers

·          Tenant’s automobile(s), make, model and license number(s)

If you fail to provide this information you will be fined $1,000.00.

All owners must provide every tenant with a copy of the Rules and Regulations of the Association. Owners will be held responsible for the behavior of their tenants and will be fined if their tenants violate the rules.

 

                Please contact the management company for the documents that you need or you can find them on the web site.

 

                Posted signs for rent or lease cannot be more than 18”x24” in size and must be removed promptly when the unit is leased or rented. Only one sign is permitted in front of the building and only the grassy area on the street.

 

                Complaints by or about tenants should be referred to the owner of the unit first, and only after negotiations with the owners to correct the problem(s) fail, should the Board of Directors be contacted.

 

Construction Projects:

 

We understand that it takes time to complete renovations and we don’t want to issue deadlines, but you must clean-up your debris and keep the common areas looking presentable. Do not overload the dumpsters with material that should be deposited at a waste facility. Violators will be fined! Projects should be completed as quickly as possible. If there is a problem you will get a notice from the Board at what actions you need to take to avoid being fined.

 

Antennas and Satellite Dishes:

               
Visible television antennas are not allowed. Please submit any plans you have for the installation of an antenna to the Board for permission. Satellite dishes are allowed but they must be placed in the most inconspicuous place possible and may not be attached to balcony railings under any circumstances and never on the roof.


Moving In:


Any damages to the common area incurred in moving in or out will be the responsibility of the homeowner. A signed release from the new occupants must be submitted to the Board stipulating that the new tenants have received a copy of the Rules and Regulations. The owner should contact the management company regarding changes to the directory and entry system. The above referenced owner/resident questionnaire form must be completed and submitted before any change to the entry system can be made. Forms are available form the management company. The cost for any change to the directory system will be based on the actual charges to the Association.

 

Moving Out:

 

Every owner must notify the Board in writing when they list their unit for sale and also the name and phone number of their agent. Only one “for sale” sign will be permitted for each unit.

 

Board of Directors/Management Company:


Except in cases of emergency, all complaints or suggestions should be made to the Board of Directors in writing. Correspondence may be mailed to the President of the Association in care of the management company.

If you have any questions about any of these rules please contact the Board. You should all familiarize yourselves and consult the CC&Rs that you were given when you closed escrow. Almost all questions can be answered by reading this document. This is the homeowner’s bible and periodically changes will be made to the CC&Rs as well as the Rules and Regulations -- but you will always be notified of these changes as prescribed by law.

 

Fine Schedule:


Any person in violation of the proscribed rules listed above will be asked to cease the violation or leave the area immediately (if applicable to the offense). Penalty for the first offense will be a warning unless specifically stated above. A second offense will result in a $25.00 fine unless otherwise stated. The third offense is $50.00. After the third offense, fines will increase by $100.00 for each offense unless otherwise stated.

               

Newsletter:

 

The Board will put out a newsletter monthly to update owners on what is going on. If you have anything you would like to share with the other owners, please send it to the Board for their use. All notifications, newsletters, and minutes from Board meetings can be found in the glass case adjacent to the pool. You will also find information on our website: www.springgardenvillas.org.

 

General Rules:

 

No loud talking or unnecessary noise is permitted at any time and especially between the quiet hours of 10:00pm to 8:00am. Consideration of your neighbors will enhance the enjoyment of all in the community.

 

Any damage to the building, recreational facilities, equipment or any other property caused by owners/residents, their children, tenant(s), guest(s) or other employee /contractor shall be considered the responsibility of the owner. And all costs of resulting repair shall be borne by such owner. Deliberate vandalism will be reported to the police and there will be a $1,000.00 fine assessed.


Garage doors are to be kept closed when unattended. THERE IS ABSOLUTELY NO USING BARBEQUES IN THE GARAGE.


No blowing of horns, no gunning of car engines is permitted and stereos cannot be played louder than normal talk, especially ones that have loud bass.

 

Other Items:


The washing machine in your unit has no safety features installed. If a hose breaks, or it leaks, the water will probably find its way down to the unit below you. You will be responsible for any damage to the bottom unit – you, not them, and not the Association. You can minimize your risk by installing a safety sensor. If any water is “sensed” on the floor the water to the machine will be shut off immediately. They run about $80.00 and are easy to install. They also make small sensors that you can set on the floor behind your toilet. If the toilet overflows or leaks it will set off an alarm to warn you. Again, if your toilet leak damages the unit below, you will be held financially responsible.


The Association carries insurance for the common areas and pool only. If the problem occurs on the inside of your front door, you are responsible for the repairs, in most cases. There are, of course, some exceptions but they would be addressed on an individual basis. Our Association general policy will not cover you. Every owner must have an INDIVIDUAL policy and send a copy of their policy to the management company.


Remember that we are one big community and it is not the intention of the Board to impose rules that take away the pleasures of home ownership, but our primary obligation is to all the homeowners. We would be derelict in our duty if we allowed dangerous conditions to exist and not correct them. We owe it to everyone to make sure the complex is neat, clean, safe and that repairs are done in a timely manner and done correctly and that we manage the financial needs of the Association prudently. If you see a condition that needs to be addressed, please contact a Board member or the management company.
